9. While I have been in the Legal Department, I have seen a number of files on which the Governor has asked the permission of the Secretary of State to make a disposition of Crown land, but I do not understand why he has thought it necessary to seek this permission. As I indicated in my minute of 11th August, I cannot see any point in his constantly referring these matters to us, and I think we might profitably review the whole matter and decide when, as a matter of policy, the Secretary of State ought to be asked to consent to dis- positions of Crown lands and when the Governor can be allowed to use his own judgment in this matter. We might then embody our conclusions in a suitable despatch, giving instructions on the matter which would revoke any previous instructions that may have been sent to him through a Secretary of State.
The draft opposite implies that the disposal of Crown lands, other than by private treaty for comprehensive workers' housing schemes, requires the Secretary of State's prior approval, and if what I have said earlier in this minute is correct, this is not in fact the case. I therefore suggest that the words I have enclosed in brackets should be deleted from the draft.
